Main duties of the job

The role of the Healthcare Legal Services Manager is to lead the Salisbury Healthcare Legal Team in the provision of a dedicated in-house legal service, to mitigate risk and achieve costs savings, across the following core areas:

·       Healthcare advice: including but not limited to consent, capacity, data protection, Mental Health Act and regulatory proceedings, for both adults and children.

·       Disclosure requests from the police and local authority on childcare and criminal proceedings, where the Trust may not be a party to proceedings.

·       Claims: management of Clinical Negligence and Third Party Claims, in line with NHSR’s schemes. We work closely with clinicians and our Divisions to robustly defend claims, protecting the interests of the Trust.

·        Inquests: support and representation of staff in the Coroner’s Court. We work closely with our local Coroners on a large portfolio of inquests.

·       Training: internal and external training on above core areas of work.

Education

Essential criteria
  • Educated to degree level in law
  • Legal practice/Bar practice course/ CILEX with appropriate post graduate level courses
Desirable criteria
  • Current Practicing Certificate as a Solicitor / Barrister / Legal Executive of the Courts of England and Wales.

Experience

Essential criteria
  • Experience of working in healthcare law/ litigation on behalf of the NHS.
  • Significant advocacy experience at Coroner’s inquests.
Desirable criteria
  • Experience of working inhouse for a large NHS organisation and knowledge of medical terminology
  • Working knowledge of NHS complaints process.
  • Experience of managing third party claims, including employers’ and public liability claims.
  • Experience of reporting and analysing data to demonstrate trends and learning
  • Management experience and ability to supervise junior members of staff.
